1. The Member is entitled to use all the facilities of the Centre (courses and squash with fees at designated times) for the period stated provided they are not in arrears in respect of any instalment due to the Company or in breach of any of the other conditions herein.
2. All terms and conditions of this Membership Agreement apply equally to all persons on the Membership Agreement including guests as if those persons were the Member. Membership is non-transferable.
3. Off-peak Members are restricted to the use of the Centre facilities between the hours of 9.00am and 5.00pm, Monday to Friday inclusive (squash and course fees may apply). The latest Centre visiting time for off-peak Members is 4.15pm.
4. Unless the Member, four weeks before expiration of the current membership, gives the Company written registered notice terminating the same the Member agrees that Membership shall automatically continue for a further year on the same terms as herein stated save that the payment due shall be the then ruling Membership Rate. Membership cards are renewable at the time membership becomes renewable.
5. a) Payments by instalments are due regardless of Centre usage. In the event of a payment default, entrance to the Centre and the use of the Centre facilities will be denied and the Centre Membership card confiscated.
b) In addition the Member is forthwith liable for the full amount due, as reflected on the face of the Membership Agreement, notwithstanding that the Company has agreed to permit them to pay the amount due in instalments. The Member accordingly agrees that if they fail to make payment of any one instalment by the due date then the full outstanding amount:-
(i) Shall become due and payable immediately
(ii) Shall accrue interest on the full outstanding amount at the prime rate charged by the Company’s banker from time to time.
c) Should the Company be obliged to institute legal proceedings against the Member arising from breach of the terms of this Membership Agreement, including but in no way limited to their failure to pay any amount due by the due date, the Member acknowledge that they hall be liable for all tracing fees, collection commission and legal costs as may be allowed by the Court.
d) The Company is registered under the Consumer Credit Act 1974.
e) The Company may disclose personal particulars contained in the Membership Agreement to a credit reference agency or any other party necessary in obtaining settlement of arrears.
6. In unusual circumstances and at the Company’s discretion, the Membership can be cancelled by paying the current membership cancellation / administration fee.
7. Centre Membership can be terminated by the Management for violation of any rule or regulation of the Centre as stated or advised from time to time or for conduct reasonably deemed by the Company to be detrimental to the welfare, good order or character of the Centre and it’s Members. The Centre shall have the right to retain the money paid by the Member to cover past use and any reasonable costs it has incurred as a result of termination.
8. (i) The Company reserves the right to alter, change, add to, reduce or cease various Centre facilities and to utilise the Centre facilities for special events, private parties, seminar, tournaments or other activities it may deem desirable.
(ii) Non-exercise facilities requiring additional payments for use or service may not be available to members at all times or at all. The providers of these services set their own tariffs and trading terms.
9. If a young adult members turns 18 in the last year of membership, the member can either upgrade to adult membership on their 18th birthday or wait until their membership year expires. Either way to continue their membership they must pay to the centre the adult joining fee applicable at the time and the prevailing adult membership rates.
10. The Company is not responsible for the loss of personal items or damage to personal property, either on the Centre premises or in the Centre parking areas unless caused by the neglect of the Centre or its staff.
11. It is the responsibility of the Member and/or the parents or guardians of children under 15 years of age to supervise their children whilst within the Centre premises. Admission times for children will be advised from time to time.
12. Smoking within the Centre is prohibited.
13. Guests must be accompanied by the Member and the number of times a guest may use the Centre during any 10 day period shall from time to time be determined by Management. All guests must be registered at the reception of the Centre.
14. By signature of this Membership Agreement the Member confirms that they and all persons covered by this Membership Agreement:
a) are physically and medically fit to proceed with the normal routines of exercise and that neither the Company nor the Centre will be responsible for any injury, accident or loss suffered by the Member or any other persons or guests covered by this Membership Agreement unless such injury, accident or loss is caused by the negligence of the Centre and/or its staff;
b) will complete all medical questionnaires prior to use of the Centre; and
15. (i) The Centre may withdraw use of all or part of each facility of the Centre due to the failure of services or for the purpose of undertaking maintenance work or any other work considered necessary. Compensation will not be given for such closures.
(ii) If through circumstances beyond the reasonable control of the Company the Centre is unable to provide the full range of services and facilities as advertised the member shall remain liable for all membership fees.
(iii) In the event of major reconstruction of the Centre premises, every effort will be made by Management to eliminate any diminution of Centre services. Membership will not be suspended and Member’s co-operation in this respect is assumed.
16. The Member hereby agrees that they and all other persons or guest covered by this Membership Agreement shall use the facilities of the Centre entirely at their own risk and that neither the Company nor the Centre shall have any liability for any loss, injury or damage sustained to them or their property unless sustained due to negligent act or omission made by the Centre or its staff. The Member accepts full responsibility for their use and the use by all other persons/guests covered by this Membership Agreement of all facilities, appliances, privilege or services at their own risk and will not sue the Centre and the Company or their Shareholders and Directors, Officers, Employees, Representatives, Agents or Lessors for any loss, claim, injury, damage or liability sustained or incurred by any person or their property unless due to a negligent act or omission by the Centre.
17. Members are required to observe the Centre’s dress, footwear and equipment codes and the Rules of the Centre as advised from time to time by the Management of the Centre.
